Workers’ Compensation FAQ

The workers’ compensation process can be overwhelming, as most injured workers have never had to file a claim before and have little idea of what to expect. At KCNS Law Group, LLP, we provide clear answers and explanations to ensure our clients are equipped with the information they need to feel comfortable to make difficult decisions.

Some of the most common questions we receive from new clients include:

How will I pay my medical bills?

If you have been hurt on the job, you are entitled to workers’ compensation benefits to cover the cost of treatment. This includes medical attention you receive right after the injury, as well as ongoing treatment and rehabilitation. You should be paid in full for the cost of medical care.

What benefits will I receive?

The value of the claim (how much you deserve) depends on the nature of the injury and the cost of fully treating it. Our attorneys are knowledgeable in evaluating injuries and working with medical professionals to accurately value how much you are entitled to receive.

You also deserve benefits to cover the cost of wages that you lost because you were unable to work due to the injury.

Am I going to be fired for filing a workers’ compensation claim?

It is illegal for an employee to be fired or disciplined for bringing a workers’ compensation claim. It is also illegal for an employer to refuse to hire you because of your injury or because you filed a workers’ compensation claim in the past.

Can I choose my own doctor?

In many cases, the insurance company or employer has a pre-approved list of doctors on its medical provider network (MPN). Generally, if the insurance company for your claim has a list, you must choose a doctor from it.

There are many exceptions and nuances to this requirement, however, and our lawyers will provide you with a clear explanation of your rights.

How long does the case take?

This largely depends on how serious the injury is and the doctor’s opinion on its severity and how to treat it. Catastrophic injuries may take longer to resolve, as the insurance company generally fights these claims and is reluctant to pay the full amount the individual deserves.

Throughout the duration of your case, we will be by your side, advocating on your behalf for the most efficient resolution possible while still recovering the full amount that your claim is worth.
